Terms of Service — SpotLeads

1. Introduction & Definitions

Welcome to SpotLeads ("the Service", "the Platform"). SpotLeads is operated by Seven Pillar House LLC, a Wyoming limited liability company ("we", "us", "our", "the Company").

SpotLeads is a web-based search tool that provides publicly available business listing data sourced from Google Maps via third-party infrastructure. SpotLeads is not a data broker. We are a search interface that enables users to find, review, save, and export publicly available business contact information.

By accessing or using SpotLeads, you ("the User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Accounts & Eligibility

To use SpotLeads, you must:

• Be at least 18 years of age;
• Be legally authorized to enter into binding contracts in your jurisdiction;
• Provide accurate and complete registration information;
• Maintain the security and confidentiality of your account credentials.

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at support@spotleads.app.

3. Service Description & Data Sources

SpotLeads provides access to publicly available business listing data from Google Maps via third-party API providers. The data returned includes business names, addresses, phone numbers, websites, ratings, review counts, and email addresses when publicly available.

You acknowledge and agree that:

• SpotLeads does not guarantee the accuracy, completeness, or freshness of any data returned;
• Email addresses are found when publicly available — typical coverage is 50-60% of businesses;
• Data may contain errors, outdated information, or missing fields;
• SpotLeads does not independently verify the accuracy of any data returned by the Service;
• Search results are temporary and automatically purged after 7 days; saved leads persist while your account is active.

4. User Obligations & Acceptable Use

You are solely responsible for complying with all applicable laws when contacting businesses found through SpotLeads. This includes, but is not limited to:

• CAN-SPAM Act: Commercial emails must include accurate sender information, clear subject lines, a functional unsubscribe mechanism, and your physical business address. You must honor opt-out requests within 10 business days.
• TCPA (Telephone Consumer Protection Act): You must check phone numbers against the National Do Not Call (DNC) Registry before making cold calls. Automated or robo-dialing requires prior express written consent.
• CCPA (California Consumer Privacy Act): If contacting California businesses, you must comply with applicable data privacy requirements.
• Any other applicable state, local, or international solicitation and data privacy laws.

Prohibited uses. You may not use SpotLeads to:

• Send bulk unsolicited email without CAN-SPAM compliance (spamming);
• Harass, threaten, or abuse any person or business;
• Use automated dialing to scraped phone numbers without prior consent;
• Resell or redistribute data in bulk to third parties;
• Use data for discriminatory purposes;
• Engage in any illegal activity;
• Scrape, reverse-engineer, or automate access to SpotLeads itself.

You must include a functional unsubscribe mechanism in any commercial emails sent using data obtained through SpotLeads. You must check phone numbers against the DNC Registry before making cold calls.

5. Subscription & Billing

• Free tier: 25 saves per month, up to 10 results per search, unlimited searches. Email and phone enrichment included. No payment required.
• Operator tier: $27/month, unlimited leads, up to 60 results per search, unlimited searches. Email and phone enrichment included. Billed monthly via Stripe.
• Cancellation takes effect at the end of the current billing period. You retain Operator access until then.
• No refunds for partial months.
• Unused leads do not roll over between billing periods.
• We reserve the right to change pricing with 30 days advance notice. Existing subscribers will be grandfathered at their current rate until the end of their then-current billing period.

6. Intellectual Property

SpotLeads and Seven Pillar House LLC retain all rights, title, and interest in the platform, including its code, design, trademarks, and proprietary technology.

You retain rights to your search queries and any content you create using exported data. Data returned by SpotLeads is sourced from publicly available business listings and is not owned by SpotLeads.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SpotLeads is NOT responsible for:

• The accuracy of business information returned;
• Whether email addresses are valid or deliverable;
• Whether phone numbers are active or on DNC lists;
• Any legal consequences from your outreach activities;
• Third-party service failures (Stripe, Google, or other API providers);
• Lost revenue, lost leads, or business interruptions.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE FEES PAID BY YOU TO SPOTLEADS IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless Seven Pillar House LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:

• Your use of the Service;
• Your violation of these Terms or any applicable law;
• Any claims arising from your outreach activities using data obtained through SpotLeads (including but not limited to CAN-SPAM violations, TCPA lawsuits, and harassment claims);
• Your infringement of any third-party rights.

9. Termination

• SpotLeads may suspend or terminate your account at any time for violations of these Terms, with or without notice.
• You may cancel your account at any time through the platform settings or by contacting support@spotleads.app.
• Upon termination, your saved leads and account data will be retained for 30 days, then permanently deleted.
• Aggregated, anonymized business directory data (not tied to your account) is retained permanently as platform intelligence.

10. Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved as follows:

1. Good faith negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation for a period of 30 days.
2. Binding arbitration: If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Wyoming or remotely.
3. Small claims exception: Either party may bring an action in small claims court if the claim qualifies.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ARBITRATION.

11. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the platform and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
